PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

a. The applicant’s record shows on 23 May 1991, Orders 101-5, DA, Personnel Service Center, Fort Riley, KS, discharged the applicant from the regular Army, effective date: 23 May 1991. The applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant’s signature. His DD Form 214 indicates that he was discharged under the provisions of Chapter 10, AR 635-200 for the good of the service-in lieu of trial by court-martial with a characterization of service of under other than honorable conditions discharge. The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records.

         b. On 23 May 1991, the applicant was discharged. At the time of discharge, the applicant had 10 months, and 14 days, service on his current enlistment under review.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l0 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for a discharge for the good of the service in lieu of trial by court-martial. The requests may be submitted at any time after charges have been preferred and must include the individual’s admission of guilt. Army policy states that although an honorable or general discharge is authorized, a discharge under other than honorable conditions (UOHC) is normally considered appropriate.

(14) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review and heard his testimony. The record is void of the specific details leading to the applicant’s separation from the Army, however, in the absence of evidence to the contrary, the Board found the applicant’s explanation of the circumstances surrounding his discharge plausible and with merit. While the Board found nothing improper in the applicant’s current discharge, based on his exemplary post service conduct and community service, it determined that his discharge is now inequitable. Accordingly, the Board voted to change the characterization of service to honorable and to change the narrative reason for discharge to Secretarial Authority.
